Unsolicited Faxes

I've finally had it. It didn't really bother me to get them when I had a separate phone line and I could just turn the ringer off and not worry about it, but now that my fax machine sits on my home phone line and these, how should I put it, um....poor excuses for blathering meat bags holding in large quantities of noxious gas , have found it. I'm starting to get a lot of calls to my home phone. The one at 11:00 pm is the one that finally pissed me off bad enough.

So, here goes. My goal (aside from making a bundle of cash off of these assholes) is to build precedent with the judge at my local Small Claims Court. By doing this against an Arizona company I hope to then be able to go after bigger fish.

To date I've recieved faxes from two (although I suspect they may be one) company. They are:

Here is a step by step list of how I'm trying to proceed in these cases. This is still a work in progress, so if you have comments or suggestions send me email.

Research the company.
File a complaint with the FCC
Prepare a demand letter.
File suit in Small Claims Court.
Provide demand letter with court documents for service.
Prepare an affadavit for court.
Prepare documentation against defense.
If the defendant doesn't answer, file for default judgement.
Go to court.
Collect judgement.
